1. PRELIMINARY PROVISIONS
- We process the following personal data as part of conducting commercial activity and cooperation with counterparties:
a) personal data of sole proprietorships,
b) personal data of natural persons not conducting business activity, who remain in legal relationships with U Jędrusia (for example, the data of persons who purchased goods at U Jędrusia stores and requested for an invoice to be issued; the data of persons who have filed complaints in relation to goods produced by U Jędrusia),
c) personal data of contact persons appointed in the name of entities conducting business activity (legal persons, organisational units with no legal personality, sole proprietorships),
d) personal data of persons authorised to represent entities conducting business activity (legal persons, organisational units with no legal personality).
2. ADMINISTRATOR OF PERSONAL DATA
- The administrator of personal data is U JĘDRUSIA Sp. z o.o. located in Przemęczanki, Przemęczanki 32, 32-107 Radziemice, KRS: 398461, NIP: 9442241567, of which records are kept by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register (hereinafter: “Company” or “U Jędrusia”).

3. CATEGORIES OF PERSONAL DATA PROCESSED BY U JĘDRUSIA
- We process the following categories of personal data:
– in the case of sole proprietorships:
a) name and surname,
b) company,
c) NIP number,
d) REGON number,
e) address of conducted business activity,
f) phone number,
g) e-mail,
h) data on the details of commercial cooperation with the Company,
– in the case of natural persons not conducting business activity:
a) name and surname,
b) address of residence,
c) phone number,
d) e-mail,
e) data on the details of commercial cooperation with the Company,
– in the case contact persons appointed in the name of entities conducting business activity (legal persons, organisational units with no legal personality, sole proprietorships):
a) name and surname,
b) phone number,
c) e-mail,
– in the case of persons authorised to represent entities conducting business activity (legal persons, organisational units with no legal personality):
a) name and surname,
b) PESEL number.
4. URPOSES AND BASES FOR PROCESSING PERSONAL DATA
- We process personal data for the following purposes:
– in the case of sole proprietorships:
a) performance of an agreement concluded with us,
b) contact related to the performance of an agreement concluded with us,
c) realisation of tax liabilities (including issuing VAT invoices),
d) marketing, formulating offers, informing about promotions, sending offer questions,
– in the case of natural persons not conducting business activity:
a) performance of an agreement concluded with us,
b) contact related to the performance of an agreement concluded with us,
c) realisation of tax liabilities (including issuing VAT invoices),
d) marketing, formulating offers, informing about promotions,
– in the case of contact persons appointed in the name of entities conducting business activity (legal persons, organisational units with no legal personality, sole proprietorships):
a) performance of an agreement concluded with us,

– in the case of persons authorised to represent entities conducting business activity (legal persons, organisational units with no legal personality):
a) performance of an agreement concluded with us,

- The legal basis for processing personal data is:
– in the case of sole proprietorships:
a) for the purposes of executing the agreement, contact related to the agreement – the processing is necessary to execute the agreement,
b) for the purposes of issuing VAT invoices – exercising the legal liability resting with U Jędrusia,
c) for the purposes of marketing, formulating offers, informing about promotions, sending offer questions – legitimate interest of U Jędrusia (conducting ongoing business activity) or consent for the processing of personal data, if such a consent is required for a specific action,
– in the case of natural persons not conducting business activity:
a) for the purposes of executing the agreement, contact related to the agreement – the processing is necessary to execute the agreement,
b) for the purposes of issuing VAT invoices – exercising the legal liability resting with U Jędrusia,
c) for the purposes of marketing, formulating offers, informing about promotions, sending offer questions – legitimate interest of U Jędrusia (conducting ongoing business activity) or consent for the processing of personal data, if such a consent is required for a specific action,

a) for the purposes of executing the agreement, contact related to the agreement – the processing is necessary to execute the agreement,
b) for the purposes of marketing, formulating offers, informing about promotions, sending offer questions – legitimate interest of U Jędrusia (conducting ongoing business activity) or consent for the processing of personal data, if such a consent is required for a specific action,
– in the case of persons authorised to represent entities conducting business activity (legal persons, organisational units with no legal personality):
a) for the purposes of executing the agreement, contact related to the agreement – the processing is necessary to execute the agreement.
5.TIME OF PROCESSING PERSONAL DATA
- Your data will be stored by us for the following periods of time:
a) For the purposes of executing the agreement concluded with U Jędrusia – until the period of limitation of any claims related to the agreement, but no earlier than 5 years from the end of the calendar year in which the deadline for settling the tax resulting from an agreement concluded with U Jędrusia expired,
b) for the purposes of issuing a VAT invoice – 5 years from the end of the calendar year in which the deadline for settling the tax resulting from an agreement concluded with U Jędrusia expired,
c) for the purposes of marketing, formulating offers, informing about promotions, sending offer questions – until a successful objection is filed against the processing of personal data (in the case when the legal basis for the activities of U Jędrusia was its legitimate interest) or until the consent is withdrawn (if the basis for the activities of U Jędrusia was a consent that you have given).
6. RIGHTS POSSESSED IN THE SCOPE OF PERSONAL DATA
- You have the right to:
a) request access to the data – you have the right to request us to provide you with any information related to your data
b) request for the data to be corrected – when your data is outdated or false, upon your request, we will correct it,
c) request for the data to be deleted – you have the right to request for your personal data to be deleted from our databases,
d) request for the scope of processing to be limited – you have the right, for example, to request us to delete part of your data, request to limit our use of your data only for certain purposes, or request to limit the period for which we will store your personal data,
e) file an objection:
– against us processing your data, which we are processing on the basis that it is essential for purposes resulting from the legitimate interest of conducting business by the Company. In the objection, you must describe your particular situation, which provides a justification for us to cease processing your personal data,
– if the personal data are processed for the purposes of direct marketing,
f) transfer the data – you have the right to request for your personal data to be sent by us directly to another administrator,
g) withdraw your consent for the processing of your personal data by us at any given moment – in such a case (if the basis for the processing was an agreement), we will cease to process your personal data; however, this will not have any impact on the conformity with the right to process the data, which was performed on the basis of your consent prior to you withdrawing it,
h) file a complaint to a supervisory authority – if you decide that the way that your personal data is processed is incorrect, you may file a complaint to the Inspector General for the Protection of Personal Data/President of the Personal Data Protection Office.
- U Jędrusia does not use automated decision-making processes, including profiling, with respect to you.
7. VOLUNTARINESS OF DATA PROVISION
- You provide us with your personal data voluntarily. A refusal to provide data required to conclude an agreement with U Jędrusia may make the conclusion of the agreement impossible. A refusal to provide contact data (phone number, email) may result in difficulties in contact related to the performance of the agreement. In the remaining scope, a refusal to provide data is not connected with any negative consequences.
8. SOURCE AND RECIPIENTS OF DATA
- Your personal data has been acquired from the following sources:
– in the case of sole proprietorships:
a) directly from you,
b) form public sources – CEIDG database,
– in the case of natural persons not conducting business activity:
a) directly from you,
– in the case of contact persons appointed in the name of entities conducting business activity (legal persons, organisational units with no legal personality, sole proprietorships):
a) directly from you,
b) from an entity in the name of which you have been appointed for purpose of contact,
– in the case of persons authorised to represent entities conducting business activity (legal persons, organisational units with no legal personality):
a) form an entity, which you are authorised to represent,
b) form public sources – KRS database.
- Your data may be transferred to the following entities:
a) specialised entities conducting IT services for our systems,
b) entities providing us with accounting and legal services,
c) marketing agencies conducting services for us,
d) public administration bodies,
e) entities providing postal and courier services.
